These Terms of Service ("Terms") govern your access to and use of the Vardhan & Jagrati online store, website, products, consultations, and related services (collectively, the "Services"). The Services are operated by Vardhan & Jagrati, Jaipur, Rajasthan, India ("Vardhan & Jagrati", "we", "us", or "our"). By visiting our website, creating an account, placing an order, or using any part of the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility and account security

You must be legally capable of entering into a binding agreement under applicable law to use the Services or make a purchase. If you create an account, you are responsible for keeping your login details confidential and for activity conducted through your account. Please notify us promptly if you believe your account has been used without permission.

2. Products, craftsmanship, and availability

Our products may include ready-to-wear, made-to-measure, bespoke, altered, or personalised garments. Because fabrics, trims, colours, and finishes can vary between production batches and screens display colours differently, minor variations may occur. These variations are part of the character of handcrafted garments and are not necessarily defects.

Products, fabrics, appointment slots, and services are subject to availability. We may limit quantities, discontinue products, correct descriptions, or update prices before accepting an order.

3. Product information and measurements

We aim to present product descriptions, photographs, sizing information, prices, and availability accurately. Measurements supplied by you must be complete and accurate. We are not responsible for fit issues caused by incorrect measurements, undisclosed preferences, or changes in the wearer's measurements after an order is confirmed.

Any styling advice, size recommendation, or estimated delivery date is guidance based on the information available at that time.

4. Orders and acceptance

Your order is an offer to purchase. An automated acknowledgement does not mean that we have accepted the order. We may accept or decline an order, request additional information, correct an obvious pricing or description error, or cancel an order where a product, fabric, or service is unavailable. If we cancel an order after receiving payment, we will refund the applicable amount using the original payment method, subject to applicable law.

5. Prices and payment

Prices are shown in the currency displayed at checkout and may include or exclude taxes as indicated there. Shipping, duties, and other charges will be shown where applicable before payment. You agree to provide current and accurate billing and payment information. Payment processing may be handled by third-party payment providers under their own terms.

6. Cancellations and changes

Please review your order carefully before payment. Once payment has been processed and work has begun, including fabric cutting, pattern drafting, embroidery, monogramming, alteration, or other personalisation, cancellation or material changes may not be possible. Where we agree to a change, additional charges and a revised delivery estimate may apply. Nothing in this section limits rights that cannot legally be excluded.

7. Bespoke, personalised, and altered garments

Garments made to your measurements or specifications are created specifically for you. Such products may not be eligible for return or exchange for change of mind, except where required by law or where the item is defective, damaged, or materially different from the agreed specification.

Personalisation requests must not contain unlawful, hateful, violent, harassing, discriminatory, obscene, abusive, or infringing material. We may refuse any request that could harm another person, violate the law, infringe intellectual property rights, or damage the reputation of Vardhan & Jagrati.

8. Fit approval and alterations

If your order is produced in stages, we may ask you to review the first garment or fitting before we complete the remaining garments. Please report fit concerns within seven days of delivery or fitting, together with clear details and photographs where requested. If we do not hear from you within that period, we may treat the fit as approved and continue production.

Agreed alterations may be completed without charge when they fall within the alteration scope confirmed by us. Additional style changes, new measurements, or requests outside that scope may involve extra charges. This process does not affect remedies available for defects or non-conformity under applicable law.

9. Shipping, delivery, and risk

Delivery dates are estimates and may be affected by fabric availability, fittings, personalisation, courier delays, events outside our reasonable control, or incomplete information from you. Please review our Shipping Policy for available methods and current terms. You are responsible for providing a complete delivery address and for any duties or taxes identified as payable by the recipient.

10. Returns, exchanges, and refunds

Returns, exchanges, alterations, and refunds are governed by our Refund Policy and applicable law. Sale items, personalised items, altered garments, and made-to-measure or bespoke products may be subject to special restrictions disclosed before purchase.

11. Promotions and vouchers

Unless an offer states otherwise, promotions cannot be combined, transferred, resold, exchanged for cash, or applied retrospectively. Offers remain subject to fabric and product availability and may have category, quantity, customer, or date restrictions. We may correct, suspend, replace, or withdraw a promotion where reasonably necessary, subject to applicable law. Purchases made during a promotion remain subject to the return terms displayed for that offer.

12. Intellectual property

The website and its text, photographs, graphics, logos, trade dress, designs, interfaces, videos, and code are owned by or licensed to Vardhan & Jagrati and are protected by applicable intellectual property laws. You may use the website for personal, non-commercial shopping and information purposes. You may not copy, reproduce, republish, modify, distribute, mirror, sell, or commercially exploit any part of the website without our prior written permission.

13. Acceptable use

You must not misuse the Services. This includes attempting unauthorised access; interfering with security or operation; introducing malicious code; scraping or harvesting information through automated means without permission; impersonating another person; submitting false information; violating another person's rights; or using the Services for an unlawful, fraudulent, or abusive purpose.

18. Indemnity

To the extent permitted by law, you agree to indemnify Vardhan & Jagrati and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, your infringement of another person's rights, or your material breach of these Terms.

19. Suspension and termination

We may restrict or terminate access to the Services where we reasonably believe you have violated these Terms, threatened the security of the website, engaged in fraud or abuse, or where suspension is required by law. Provisions that by their nature should survive termination will remain effective.

20. Governing law and disputes

These Terms are governed by the laws of India. Subject to any consumer rights or jurisdiction that cannot be waived, disputes will be subject to the courts of Jaipur, Rajasthan. Before starting formal proceedings, both parties should attempt in good faith to resolve the dispute through written communication.

21. Changes to these Terms

We may update these Terms to reflect changes to our Services, business practices, or legal obligations. The revised Terms will apply from the date posted on this page. Your continued use of the Services after that date means you accept the updated Terms.

22. Severability and entire agreement

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms, together with the policies and order-specific terms referenced here, form the agreement between you and Vardhan & Jagrati regarding the Services.

23. Feedback

Suggestions or feedback you voluntarily provide may be used by us without restriction or compensation, provided that we will handle personal information in accordance with our Privacy Policy.
